أمن الرسل في الفقه الإسلامي

الملخص
الملخص: إن أصل الحصانة الدبلوماسية يعود إلى نشوء الدول في العصور القديمة، حينما كانت تتبادل مع بعضها البعض العلاقات التجارية والسياسية والثقافية والإقتصادية، حيث كانت تسعى دوما للإتصال فيما بينها للإنتفاع من بعضها البعض أو لتسوية النزاعات التي قد تنشأ بين أفرادها لإيجاد الحلول الملائمة لها، فسادت أعراف كإرسال الرسل والمبعوثين للتواصل مع الطرف الآخر إذا ما كان هناك مسألة مشتركة بين الدول لحل الخلافات والنزاع ومعالجة الأمور العالقة بينهم بطرق ودية. وكانت تلك الرسل والبعثات تتمتع بعدم الإعتداء عليهم ويعاملون معاملة تليق بكرامتهم ومكانتهم لما يقومون به من دور هام لصالح شعوبهم، فكانت هذه نواة الحصانة الدبلوماسية في الدولة الحديثة. Abstract: The origin of diplomatic immunity dates back to the emergence of countries in ancient times, when they traded among themselves commercial, political, cultural and economic relations, where they always sought to communicate with each other to profit or settle disputes that may arise between their members in order to find appropriate solutions, corrupt customs such as sending messengers and envoys to communicate with the other party if there is a common problem between countries to resolve disputes and conflicts and resolve outstanding issues among themselves in a friendly manner. These Apostles and Missions enjoyed non-aggression and were treated with dignity and prestige for the important role they play in the interest of their people: it was the core of diplomatic immunity in the modern state.
