العوامل الموضوعية و المؤسساتية المؤثرة في تشكيل المجالس المنتخبة

الملخص
يمر تشكيل المجالس المنتخبة بمجموعة من المراحل التي لها تأثير كبير وبارز عليها سواء تعلق الأمر بتحديد الدوائر الانتخابية أو الحملة الانتخابية،هذا كما تؤثر الهيئة المكلفة بإدارة العملية الانتخابية في تشكيلها عندما لا تلتزم بمبدأ الحياد المتطلب منها قانونا، وكذا الأحزاب السياسية عندما لا تختار مرشحيها بناء على معايير وأسس موضوعية متعلقة أساسا بالكفاءة و الخبرة. ويترتب على هذا التأثير سواء الموضوعي منه أو المؤسساتي أن تكون هاته المجالس المنتخبة غير معبرة حقيقة عن رأي وإرادة الشعب،كما أنها قد تؤدي إلى الحيلولة دون اكتساب أكفء الأشخاص العضوية فيها. وتأتي دراستنا هاته من اجل بيان ودراسة هاته العوامل المؤثرة في تشكيل المجالس المنتخبة سواء الموضوعية منها أو المؤسساتية وذلك بشيء من التفصيل. Abstract : The formation of the elected councils passes by a set of stages that have a significant and prominent impact on it, whether in the determination of the electoral districts or the electoral campaign, in the same time the organism responsible on the management of the electoral process impacts their formation when they do not adhere to the neutrality principle that is required legally, as well as the political parties when they do not choose their candidates depending on an objective criteria and basis that are mainly related to competence and experience. The consequences of this influence, whether the substantive or the institutional one, are that these elected councils do not represent in fact the opinion and the will of the people, as it may lead competent persons not to acquire a membership. Our study comes to show and to study these factors affecting the formation of the elected councils, both of which, the substantive or the institutional ones, with some detail.
