أسباب وأهداف التعديل الدستوري في الجزائر دراسة في ظل التحولات العربية الراهنة

الملخص
لقد طال الدستور الجزائري الأول لسنة 1963، ثم دستور 1976، فدستور 1989، وأخيرا دستور 1996، تعديلات يمكن اعتبارها أساسية لاسيما الواقعة منها سنتي 2002 و 2008، وكذا التعديل المرتقب بعد جلسات الاستماع لبعض الشخصيات الوطنية والأحزاب السياسية وبعض المختصين خلال 2014، ثم ما يدور من حديث عن نفس الموضوع ونحن في شهر نوفمبر من سنة 2015 ، فلقد كان وراء تلك التعديلات أسباب مُحفزة، وأهداف مطلوبة، وهي لم تخرج في مجملها عن الأسباب والأهداف السياسية وتارة الشخصية، فعند نشوء دولة جديدة سيشكل إنجاز دستور لها أولوية الأولويات، كما أن الدستور المعمول به سيحتاج إلى بعض التعديل في أي وقت ليستجيب لطموحات وتطلعات الأمة، ومن ثم ستكون فكرة الحصانة المطلقة ضد التعديل غير مفيدة. فلقد حصل ذلك في الجزائر وفي بقية الدول العربية خاصة في سوريا والعراق ومصر وتونس والسودان، وعَقِبَ كل ثورة سِلْمية كانت أو مُسلحة، لأسباب ودوافع سياسيةٍ ولتحقيق أهداف مشروعة، وهذه كان لها الأثر البارز في إصدار دساتير أصلية أو نسخا معدَّلَةً من الدساتير السابقة . Abstract: Several amendments were applied on the first Algerian constitution 1963, Then the 1976 constitution, and the 1989 constitution ,as well as in 1996. Noticeably and specially the two amendments that were applied on 2002 and 2008, as well as the expected amendment after the Hearing of national figures, political parties and experts on 2014. Many motivating reasons and needed goals were behind those amendments which didn’t deviate from the main reasons and political motivations, and sometimes personal. At any instance of any state establishment the first priority is given for drafting a constitution, which will be necessarily amended through the coming years so that to meet the nation’s needs and aspirations. From this aspect, the idea of total immunity an unchangeable constitution is a nonsense This was the case for Algeria and many other Arabic countries such as Syria , Iraq , Egypt , Tunisia and Sudan after every revolution be it peaceful or armed ,with political ;motivations and reasons is to achieve legitimate goals . this had the greatest impact on making or amending constitution .
