موقف المشرع الجزائري من تصدير النفايات الخطرة - The Position Of The Algerian Legislator on The Export Of Hazardous Wastes

الملخص
انضمت الجزائر إلى اتفاقية بازل بشأن التحكم في نقل النفايات الخطرة والتخلص منها عبر الحدود، التي تعتبر اتفاقا عالميا يؤطر موضوع النفايات الخطرة، خاصة ما اتصل بحركتها عبر الحدود. وقد قامت الجزائر بموائمة تشريعها الداخلي وفقا لمتطلبات أحكام هاته الاتفاقية، من خلال إصدار القانون رقم 01 – 19 المؤرخ في 27 رمضان عام 1422 الموافق 12 ديسمبر سنة 2001، والمتعلق بتسيير النفايات ومراقبتها وإزالتها ونصوصه التطبيقية. في هذا الإطار، ستعالج هذه الورقة موقف المشرع الجزائري من تصدير النفايات الخطرة، في ظل أحكام القانون المتعلق بتسيير النفايات، وتستعرض جهوده التي بذلها من أجل تحصين البلاد من مخاطر وأضرار النفايات الخطرة. وبما أن تصدير النفايات الخطرة هو عمل مشروع خطير، وجب على الدولة التدخل لإحاطة العمليات والممارسات المرتبطة به بأطر تضمن أمن الأشخاص والممتلكات وكذا سلامة صحة الإنسان وبيئته، وهو الأمر الذي تم تدعيمه بعد قيام المشرع الجزائري بتعزيز نظامه القانوني بإصدار المرسوم التنفيذي رقم 19 – 10 المؤرخ في 16 جمادى الأولى عام 1440 الموافق 23 جانفي سنة 2019، الذي ينظم تصدير النفايات الخاصة الخطرة. Algeria has acceded to the Basel Convention on the control of transboundary movements of hazardous wastes and their disposal, a global agreement that regulates hazardous wastes topic, in particular its cross-border movement. Algeria has harmonized its domestic legislation in accordance with the provisions of this Convention, which is reflected in the promulgation of law n°. 01-19 of Ramadan, 27th, 1422, corresponding to December, 12th, 2001, on the management, control and disposal of wastes, and its implementing texts. In this context, this paper address the position of the Algerian legislator on the export of hazardous wastes, under the provisions of the law on waste management and its efforts to safeguard the country from the risks and damages of hazardous wastes. As the export of hazardous wastes is a dangerous legal act, the State intervene in order to ensure that its operations and practices are protected by a frameworks guaranteeing the security of persons and properties as well as the safety of human health and its environment, especially after the Algerian legislature has strengthened its legal system by issuing Executive Decree n°. 19-10 of Jumada oula, 16th, 1440 corresponding to January 23th, 2019, which regulates the export of hazardous special wastes.
