الطفل في حالة خطر على ضوء القانون 12/15

الملخص
الملخص الطفل كالصفحة البيضٌاء تكتب عليهٌا ما تشاء ، فهو القاعدة الاساسيةٌ لكل المجتمعات و اساس بنائها ، وان تعدد الثقافات و اندماجها في عصر العولمة او بالأخص في عصر التكنولوجيا ، جعله يعيش في صور الرفاهية و الازدهار و النمو و في مقابل ذلك اضحى يعيش اوضاعا ليست بعيدة عن اوضاع كان يعيشها في العصور السابقة ، في صور جديدٌة من مختلف صور الاستغلال سوآءا كانت اجتماعية او اقتصادية او ثقافية ، جعلته محل استغلال فسارعت التشريعٌات الدوليةٌ بوضع قواعد قانونية لحمايته والزمت الدول بضرورة احترام ذلك ، بموجب تعديل تشريعاتها الداخلية فنصت غالبية التشريعات المقارنة و منها التشريع الجزائري على ضرورة حماية هذه الفئة ، وهو ما التزم به التشريع الجزائري منذ مصادقتها على اتفاقية حقوق الطفل لعام 1989 ، وصولا الى صدور القانون 15/12 المتضمن حماية الطفل سوآءا باعتباره ضحية او بصفته جانح من جهة ، و من جهة اخرى سوآءا في ظل الحماية الوقائية الاجرائية أو الحمايةٌ العلاجية القضائية .
