منازعات شهادة الحيازة

الملخص
شهادة الحيازة هي محرر رسمي استحدث بنص المادة (39) من قانون التوجيه العقاري (90/25) وتظهر أهميتها من خلال بساطة إجراءات الحصول عليها مقارنة بالآثار الهامة التي ترتبها لصاحبها . وهي تخضع لمجموعة من الشروط والإجراءات للحصول عليها, تتمثل هذه الشروط في : وجوب أن يكون العقار محل الطلب من الأملاك العقارية الخاصة, أن لا يكون للعقار عقود ملكية سابقة, ووقوع العقار في مناطق غير ممسوحة ,إضافة إلى وجوب توفر الحيازة الممارسة على مدة سنة.بينما الإجراءات فهي بسيطة جدا تتمثل في تصريح شرفي, مخطط وشهادة شاهدين تؤكد ممارسة الطالب للحيازة مدة سنة. أما بالنسبة للمنازعات التي يمكن أن تثار بشأنها فيتراوح اختصاص الفصل فيها بين القضاء العادي وبالتحديد القسم العقاري على مستوى المحاكم العادية إذا تعلق النزاع برفع الاعتراض المسجل على تسليم شهادة الحيازة وبين القضاء الإداري الذي يختص بالفصل في المنازعات المثارة ضد قرارات المحافظ العقاري المتعلقة بشهر هذا السند وتلك الرامية إلى إلغاء شهادة الحيازة. الكلمات المفتاحية: شهادة الحيازة ؛ الاعتراض؛ رفع الاعتراض ؛ الإلغاء؛الاختصاص Abstract: Possession of a certificate is the official document presented the text of Article (39) of the Directive on the property right (90/25) is the President of the Municipal People's Congress, and to show their importance through to simpler procedures to obtain comparable important effects organized by the owner.
