قراءة في مدى كفاية صور الحماية الجزائية للأملاك الوقفية

الملخص
يتميز الوقف بطبيعة خاصة جعلته الحلقة الأضعف بين أنواع الممتلكات ، ما يجعله عرضة للاعتداء و الإهمال، و تلك اعتبارات تستدعي خصوصية في حمايته بتجريم أي اعتداء عليه ، تحقيقا لديمومة الانتفاع به و استمرارية وجوده ، لكن بتحليل النصوص التشريعية ذات الصلة خلصنا أن صور الحماية الجزائية للأملاك الوقفية لا تعدو كونها في سياق الجرائم المرتبطة بالملكية عموما ، فلم يفرد لها المشرع أية خصوصية تتماشى و طبيعتها ، و من ثمة لم تكن كافية في حمايتها . The Waqf is characterized by a special nature that made it the weakest link among all types of property and thus became subject to abuse and neglect. These considerations require special feature in protecting it by criminalizing any aggression against it, in order to perpetuate its use and its continuity. Nevertheless, we concluded through the analysis of relevant legislative texts, that the forms of penal protection of Waqf property is just included in the context of property-related crimes in general, and that the legislator has not defined any specificity consistent with its nature, and thus has not been sufficient to protect it.
