إنعاش الاقتصاد عبر تقنية تفويض المرفق العام في التشريع الجزائري

الملخص
لقد أظهرت الدولة المتدخلة في سنوات سابقة بعض النجاحات في مجال التنمية وذلك بقيادة الدولة لمشروع التنمية الاجتماعية و الاقتصادية، إلا أن الأزمة العالمية لسنوات السبعينات والتي ميزها الكساد، وندرة الموارد أدت إلى تراجع نموذج الدولة المتدخلة ، فظهرت الحاجة إلى ضرورة مراجعة دور الدولة ، هدفه تحسين الاقتصاد بفتح مجال الاستثمارات بشتى التقنيات، وبهدف تحسين معيشة الأفراد في المجتمع، فاستدعى الامر فتح المجال لأطراف أخرى قصد الاسهام في رقي الاقتصاد و تنميته . ومن ثمة ظهرت حاجة المرفق العام إلى نموذج جديد للتسيير يُمكنه من المنافسة في اطار النجاعة والشفافية، ووفق مبادئ سير المرفق العام المرتبطة بالاستمرارية ، المساواة و القابلية للتكيف ، فجاء المرسوم الرئاسي 15-247 حاملا لبعض الاصلاحات ، لكنها غير كافية ، وعليه فإن هذه الدراسة استشرافية تهدف أساسا إلى تسليط الضوء على فكرة المرفق العام ودوره في مجال الاستثمار للتوصل إلى الاثار المترتبة عن اعتناق المشرع لتقنية التفويض العام و التي ترتبط بفكرة تحسين مناخ الأعمال وكذا عصرنة المرفق العام . Abstract: In the previous years, the interventionist state showed some successes in development, led by the State for the project of social and economic development. However, the global crisis of the 1970s characterized by the recession and the scarcity of resources led to the decline of the interventionist state model. To open the field of investments in various technologies and in order to improve the lives of individuals in the community, it was necessary to open the field to other parties in order to contribute to the development of the economy and development. The General Facility was therefore in need of a new governance model that could compete in the context of efficiency and transparency. In accordance with the principles of the functioning of the General Facility related to continuity, equality and adaptability, presidential decree 15-247 contained some reforms, but it was insufficient. Aims mainly to highlight the idea of the General Facility and its role in investment to reach the implications of the legislator's adoption of the general authorization technology, which is related to the idea of improving the business climate as well as modernization of the public utilit.
